Welcome to Art of Sundays. These Terms of Service ("Terms") govern your access to and use of artofsundays.co and the products and services we offer (the "Services"). artofsundays.co is operated by Art of Sundays Prints LLC (“Art of Sundays”, “we”, “us”), a limited liability company registered in the State of New York, United States. By using our site or placing an order, you agree to these Terms. Our store is powered by Shopify.

Our products

Every Art of Sundays print is produced individually for your order. As prints are produced on demand, slight variations in colour between your screen and the finished print are normal and not considered defects. Sizes are listed for each piece; please choose carefully.

Pricing & payment

Prices are shown in your market's local currency and include shipping. We may update prices, products, and availability at any time. Payment is taken at checkout; your order is confirmed once payment is received.

Orders, cancellations & acceptance

We may decline or cancel an order at our discretion (for example, suspected fraud or an error in price or description). Because production begins quickly, cancellations are accepted on a case-by-case basis and only before your print has gone to print; see our Refund Policy. Shipping and returns are governed by our Shipping Policy and Refund Policy.

Intellectual property

All artwork, imagery, designs, and content on this site are owned by Art of Sundays or our licensors and are protected by copyright. Your purchase is for personal, non-commercial display only; you may not reproduce, resell, or redistribute the artwork.

Acceptable use

You agree not to misuse the Services, attempt to disrupt the site, or use it for any unlawful purpose.

Disclaimers & limitation of liability

The Services are provided "as is." To the fullest extent permitted by law, Art of Sundays is not liable for any indirect, incidental, special, or consequential loss arising from your use of the Services, and our total liability to you for any claim relating to an order will not exceed the total amount you paid for that order. Nothing in these Terms limits any rights you have under applicable consumer law.

Dispute resolution, arbitration & class-action waiver

If you have a concern or dispute, please contact us first at support@artofsundays.co so we can try to resolve it informally; most issues are settled this way.

To the fullest extent permitted by law, any dispute that cannot be resolved informally, and that is not covered by the carve-out below, will be resolved by final and binding individual arbitration rather than in court, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in New York, under the U.S. Federal Arbitration Act. You and Art of Sundays each waive any right to a jury trial, and agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding. You may still bring a qualifying individual claim in your local small-claims court.

You may opt out of this arbitration agreement by emailing support@artofsundays.co within 30 days of first agreeing to these Terms, stating your name and that you opt out of arbitration. If you opt out, disputes will be handled under the "Governing law" section below instead. Opting out does not affect any other part of these Terms.

Mandatory-rights carve-out. Nothing in this section applies where it is prohibited or unenforceable under the mandatory consumer law of your country or state of residence. Consumers in Australia, the United Kingdom, the European Union, and elsewhere keep any non-waivable right to bring proceedings in their local courts and to the protections of their local consumer law, as set out under "Governing law" below.

Governing law

These Terms are governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict-of-law principles, and you agree that the state and federal courts located in New York will have jurisdiction over any dispute arising from them. This does not remove any mandatory consumer-protection rights you have under the law of your own country or state of residence (for example the Australian Consumer Law, or applicable United Kingdom or European Union consumer law), which continue to apply to you.

Changes

We may update these Terms from time to time; the current version always applies.

General

If any provision of these Terms is found unenforceable, the remaining provisions stay in full force. Our failure to enforce a right is not a waiver of it. We are not responsible for delays or failures caused by events beyond our reasonable control, including print-partner or carrier delays, strikes, or other force-majeure events. You may not transfer your rights under these Terms without our consent; we may assign ours to an affiliate or successor. These Terms, together with the policies they reference, are the entire agreement between you and Art of Sundays regarding the Services.
